"Administrative Measures for the "Multi-drawing Joint Review" of the Construction Drawing Design Document of Shanghai Engineering Construction Project”
Article 1 (Purpose and Basis)
In order to implement the "Guiding Opinions of the General Office of the State Council on Construction Projects Approval System Reform Pilot" (issued by the General Office of the State Council [2018] No. 33) and "Implementation Plan of Shanghai Construction Projects Approval System Reform Pilot" (issued by Shanghai Municipal Peoples Government [2018] No. 14), these Measures are formulated with reference to the relevant provisions of Ministry of Housing and Urban-Rural Development and municipal construction project design document review document.
Article 2 (Scope of Application)
These Measures apply to the new construction, reconstruction and expansion of housing construction projects and municipal infrastructure projects within the administrative area of this Municipality.
Article 3 (Definition of "Multi-drawing Joint Review")
“Multi-drawing joint review” refers to the technical approval affairs of fire protection, civil defense, sanitation, water affairs, earthquake and other management departments being included in the construction drawing design documents approval and the construction drawing review agency entrusted by the relevant management department shall adopt digitization online drawing review method for the uniform review of construction drawing design documents and the fire protection design, air defense basement design with the combination of civil construction, preventive hygienic design, water-saving facilities design, and earthquake fortification design (except for super high-rise special fortification review).
Article 4 (Division of Responsibilities)
The Shanghai Municipal Housing and Urban-Rural Construction Management Committee (hereinafter referred to as the “Municipal Housing and Urban-Rural Construction Management Committee”) is responsible for the comprehensive management of the "multi-drawing joint review" of construction drawing design document of the city's construction projects. The Shanghai Municipal Engineering Design Document Review Management Center (hereinafter referred to as the “Municipal Review Center”) entrusted by the Municipal Housing and Urban-Rural Construction Management Committee is responsible for the specific management of the "multi-drawing joint review" of construction drawing design document of the city's construction projects. All district construction management departments and the municipal-level specific area management committees shall perform relevant management and service work according to their own responsibilities.
The administrative departments of fire protection, civil defense, sanitation, water affairs, and earthquake resistance shall implement professional management and technical support for the “multi-drawing joint review” of the city's engineering construction projects according to their own responsibilities.
Article 5 (Entrustment Means)
The construction unit independently selects the approved construction drawing review agency to review the construction drawing design documents and pay the review fee.
The management departments such as fire protection, civil defense, sanitation, water affairs, earthquake resistance, in accordance with their lawful duties, entrust the same approved construction drawing review agency for the uniform review of fire protection design, air defense basement design with the combination of civil construction, preventive hygienic design, water-saving facilities design, and earthquake fortification design (except for super high-rise special fortification review).
Article 6 (Construction Drawing Review Contract)
The construction unit shall determine the construction drawing review agency and sign the construction drawing review contract before applying for the construction permit. The construction unit shall complete the construction drawing review contract information submission through the “one-time magagement on network” Shanghai engineering construction project approval management system (construction engineering joint review sharing platform) (hereinafter referred to as the “joint review platform”).
Article 7 (Technical Consulting Service)
During the construction drawing design and review processes, the construction unit and the survey and design unit can consult the relevant management departments online if they have any question about the affairs such as the super high-rise earthquake fortification design, air defense basement design with the combination of civil construction, and fire protection design. The consultation of the relevant departments shall be taken as the basis for the design and review of construction drawings.
Article 8 (Review Application)
After the completion of the construction drawing design documentation, the construction unit shall log in to the “joint review platform” to fill out the construction permit application form, upload the corresponding materials, and notify the design unit to upload the construction drawing design documents once as required. The construction unit shall submit the application examining the construction drawing design documents and related materials to be correct and the materials submitted by the construction unit includes:
(1) The full set of application drawings and design documents shall comply with the requirements of electronic drawing format and digital signature specified in the "Implementation Essentials of Shanghai Municipal Engineering Design, Construction and Completion Drawing Digitization and White Map Delivery" (Shanghai Construction Management Committee [2016] No. 596);
(2) Other materials that clarified by the laws and regulations shall be submitted.
Article 9 (Application by Stages or Phases)
The construction unit may submit the construction drawing of the engineering construction project once for the review, or may submit it by unit (body) project stage or phases of pile foundation, main body, curtain wall and deep foundation pit for the review.
For the review by stage or phases, the unit (body) project scope of the construction drawing design document review at each phase and stage shall be consistent with the details of the unit (body) project of the the construction permit applied and the same project shall entrust the same construction drawing review agency.
Article 10 (Review Acceptance)
The “joint review platform” shall notify the construction drawing review agency for the construction drawing review after accepting the construction drawing review agency shall check the conformity of the submitted materials within 5 working days:
(1) Whether the materials submitted are complete;
(2) Whether the survey and design unit fills out the design personnel as required and whether the survey and design enterprise and the registered personnel and related personnel carry out digital signatures and signatures on the construction drawings as required.
The correction of the materials submitted as needed shall be notified at one time.
Article 11 (Technical Review Contents)
The construction drawing review agency shall review the following contents:
(1) Whether it meets the mandatory standards for engineering construction;
(2) The safety of the foundation and the main structure;
(3) Whether it meets the mandatory standards for civil building energy conservation, and whether the project for green building standards is consistent with the green building standards;
(4) Whether it meets the review contents and standards entrusted by the administrative departments of fire protection, civil defense, sanitation, water affairs, and earthquake resistance;
(5) Other contents that must be reviewed by laws, regulations, rules, etc.
Article 12 (Time Limit of Review)
The time limit for construction drawing of the “house construction project” invested by the government is 20 working days; the time limit for construction drawing of the "municipal linear (non-independent land occupation) projects" is 10 working days; and the time limit for “municipal transportation linear project” is 15 working days.
The time limit for construction drawing review of“industrial project” invested by the government is 10 working days; the time limit for “small projects” is 15 working days; the time limit for "three types of protection projects” and “other projects” is 20 working days. The construction drawing review time limit is calculated from the date of acceptance to the date of approval, not including modification time of the construction drawing and the long-term review organization and review time. The expert review time as required according to the regulations shall not be counted in the review time.
Article 13 (Review Results)
(1)For those qualified, the construction drawing review agency shall issue the “Qualification Certificate for Joint Review of Construction Drawing Design Documents of Shanghai Engineering Construction Project” (hereinafter referred to as the “Joint Review Qualification Certificate”) and apply the digital signature on the approved electronic drawings and related materials. The “Joint Review Qualification Certificate” shall specify that it is consistent with the review requirements for the approval departments such as fire protection, civil defense, health, water, and earthquake resistance. The review opinions issued by the construction drawing review agency shall be taken as the management department opinions and the approved construction drawing design documents and related materials shall be taken as the basis for follow-up supervision.
(2) For those failed, the construction drawing review agency shall inform the review opinions once and the revised construction drawing design documents and related materials shall be reported to the original construction drawing review agency for review.
Article 14 (Dispute Management)
The technical dispute between the review opinions submitted by the construction drawing review agency and those of the survey and design unit shall be managed in accordance with the Notice on the Quick Management of Dispute Appearing in the Process Construction Drawing Design Document Review (Shanghai Municipal Construction Review Office [2017] No. 13).
Article 15 (Design Changes)
Any unit or individual may not revise the approved construction drawings; The construction unit shall upload the construction drawing design documents and the relevant materials which need to be revised and involved in the review contents specified in the Measures to the “Joint Review Platform” and submit them to the original construction drawing review agency for review.
Article 16 (Architect Responsibility System)
The construction unit and the execution architect can apply for the construction permit for the projects included in the architect responsibility system pilot by the informing and pledging method and the construction management department shall first issue the permit. The construction unit and the execution architect shall complete the procedures of "multi-drawing joint review” of the construction drawing design document within three months from the date of receiving the construction permit and receive the “Joint Review Qualification Certificate”. During the period, the construction management department shall supervise and inspect whether the applicant's commitment is true.
Article 17 (In-Process and Postmortem Supervision)
The approval departments of fire protection, civil defense, sanitation, water affairs and earthquake resistance shall entrust the construction drawing review agency to review the construction drawing design documents. The approval departments can check the situation simultaneously in the process and can propose opinions through “joint review platform” to remind the construction drawing review agency and the construction unit.
After the completion of review of construction drawing review agency, the approval departments can perform spot check of the construction drawing review agency and can submit the rectification opinions to the construction unit according to law for any violating the review requirements. They shall order the construction unit to stop construction or use in accordance with the law and shall, according to the circumstances, suspend or cancel the review qualification of the construction drawing review agency entrusted for any with major safety hazards.
The Municipal Housing and Urban-Rural Construction Management Committee shall uniformly organize the approval departments to jointly formulate the inspection plans and implement joint inspections in accordance with the principle of “double random and one publicity”.
The Municipal Housing and Urban-Rural Construction Management Committee shall take the lead in organizing relevant management departments to establish the supervision and inspection expert database for “multi-drawing joint review” and shall formulate expert database administrative measures. The supervision and inspection expert shall be randomly selected from the expert database.
Article 18 (Legal Responsibilities of the Review Agency)
The construction and related management departments shall strengthen the supervision and management of “multi-drawing joint review”, and urge the all the partners of projects to intensify the responsibility for survey and design and construction drawing review and strictly implement the primary responsibility of the construction unit, the main responsibility of the survey and design unit and review responsibility of review agency.
The construction drawing review agency is responsible for the “multi-drawing joint review” of the construction drawing and assumes the responsibility for review. The review agency shall bear corresponding legal liabilities and compensation liabilities for any loss of the approved construction drawing with violations of the legal, regulatory and engineering construction mandatory standards and the requirements of the examination contents entrusted by the relevant management departments.
Article 19 (Review Satisfaction Evaluation)
The Municipal Housing and Urban-Rural Construction Management Committee shall regularly organize satisfaction evaluation of the construction drawing review agency in the way of entrusted third-party evaluation and the evaluation results shall be taken as the reference for supervision and determination.
Article 20 (Data Statistics)
All relevant management departments shall regularly submit the “multi-drawing joint review” inspection data of this department to the municipal review center which shall conduct statistical analysis on the inspection and form the survey and design quality analysis report in the city with the combination of survey design quality problems reported by the construction drawing review agency to be published regularly.
Article 21 (Training Instruction)
The municipal review center shall regularly organize relevant management departments to conduct technical training on the construction drawing review agency and relevant units.
Article 22 (Implementation Time)
The Measures shall be implemented from December 1, 2018 and shall be valid for two years.
